Does Etsy train AI on your listing photos? Etsy's December 2026 Terms explained
Published 4 November 2026 · Last checked 4 November 2026 · 4 minute read
The short answer
From 16 December 2026, Etsy's Terms of Use allow Etsy and its third party partners and vendors to use content you upload, such as listing photos and descriptions, to develop and train AI. You keep ownership, but the licence you give Etsy is perpetual and irrevocable.
The Terms make this "subject to any applicable opt-out rights described in our Privacy Policy". We read that policy on 4 November 2026 and found no opt-out form or setting specific to AI training. It does describe a general right to object, which has limits.
This is a plain-English summary, not legal advice. Etsy's own pages are the authority, and Printable Pilot isn't affiliated with or endorsed by Etsy.
What changed and when
Etsy's updated Terms and Privacy Policy were published on 26 October 2026 and take effect on 16 December 2026. Section 5 of the Terms now says Etsy, its partners and its vendors can use your content to develop, train, test and improve AI and machine learning, including to improve its services or help keep them safe.
The Privacy Policy gives listing information, product reviews and community posts as examples of content it may use to train AI models, and mentions features such as AI listing tools and AI review summaries.
What counts as your content
The Terms define it as anything you post through Etsy, including shop names, profile pictures, listing photos, listing descriptions, reviews, comments, videos and usernames.
You still own it, but the licence is broad
Etsy says it doesn't claim ownership. The licence you grant is worldwide, royalty-free, sub-licensable, irrevocable and perpetual. Value Added Resource reports that this licence already existed, and that the AI wording is the addition. It also notes the new wording doesn't necessarily mean this is the first time Etsy has trained AI on such content.
Is there an opt-out?
The Terms point to the Privacy Policy. The UK version of that policy lists AI training among the things Etsy does for its legitimate interests. We didn't find a separate AI training opt-out in it, but that's our reading of the document, and Etsy could offer one elsewhere or add one later.
Value Added Resource found no general way for US sellers to keep their content out of AI training while still selling on Etsy.
UK sellers and the right to object
Etsy's Privacy Policy says people in the UK and EEA can object to processing based on legitimate interests. It says Etsy will stop unless it has compelling legitimate grounds to continue or the processing is needed for legal reasons. The ICO guidance also says this right isn't absolute, and that you need to give reasons based on your own situation.
This right covers personal data. Value Added Resource says these protections may not cover every type of creative content, so a printable design may fall outside it. We don't know how Etsy would handle an objection about listing images.
Deleting listings or closing your shop
Etsy's Terms say that if you don't agree to changes you may close your account, and that closing it won't affect the availability of some content you've already posted. Value Added Resource reports that removing a listing or closing a shop may not end Etsy's permission to use earlier uploads, and that Etsy hasn't clarified how it treats that material.
Outside AI firms
The Terms also say nobody may use content from Etsy's services to develop or train AI without Etsy's express permission. That restricts outsiders. It doesn't limit Etsy or the partners and vendors it authorises.
| Etsy's documents say | Reporting says | Not known yet |
|---|---|---|
| Etsy and its partners and vendors may use your content for AI | The licence isn't new; the AI wording is | Who those partners and vendors are, and if they can use content outside Etsy |
| Opt-out rights apply where the Privacy Policy describes them | No general opt-out for US sellers | Whether an objection works for designs and listing images |
| Closing your account won't affect the availability of some content | Removing content may not end the permission | How deleted listings are treated in AI training |
| AI training is listed as a use of uploaded content | This may not be the first time it's happened | Whether Etsy has already trained AI on seller content |
What you can do now
- Read the Terms of Use and Privacy Policy yourself before 16 December. Etsy's privacy page links to each language version.
- Send privacy questions or a rights request to Etsy's Data Protection Officer at [email protected], the contact the policy gives.
- If you're unhappy with how a data protection request is handled, the policy names the ICO as the UK regulator.
- If this matters for your business, ask a qualified adviser.
FAQ
When do Etsy's new Terms start?
Etsy published them on 26 October 2026 and they take effect on 16 December 2026.
Do I still own my designs?
Yes. Etsy's Terms say it makes no claim to your content, but you give Etsy a broad licence to use it.
Can other AI companies train on my Etsy listings?
Etsy's Terms ban anyone from using content from its services to train AI without Etsy's express permission. That's a rule, not a guarantee nobody will break it.
